I read an article today in the Daily Mail about a female motorist who had her car clamped while she was still at the wheel. The woman, Jessie Martin, pulled into the car park to make a U-Turn, but two vans from a clamping firm pulled in to block her exit. The men from the clamping firm approached her, ordered her to switch off the engine and when she obeyed, fitted a clamp to her car.
So what can you do in a situation like this? Well, sdemnips from Birmingham has the following advice:

Here’s what you do

1. Tender nominal damages, say £5 for your inadvertent trespass.
2. Warn them you’ll sue them and the owner of the land if they don’t release your car immediately.
3. If they don’t release your car, do a land registry search and identify the land owner – the only person with the legal right to object to trespassing.
4. Write to the land owner ( who really won’t want the hassle) and demand release and damages for trespass to your goods by its agents, warning you’ll sue if they don’t pay up within 7 days but offer a credit of £5 against those damages for your trespass.
5. If they don’t release and pay up sue the owner as first defendant and clamper as second defendant in the small claims court for damages.
6. Enforce the judgement against the land owner.

He also states, "When I was clamped the clamper returned my car within days when it realised I meant what I said, but I still sued and recovered damages of £750 from the land owner -more than the car was worth!".

I read the following cry for help on Kioskea’s blog the other day and thought to myself, how many times have I had a similar problem, the answer of course being, many times.

"I had to have everything re-loaded onto my computer, at a local shop. Now everything thing works except my speakers, or even headphones on the front plug.
